Terms & Conditions

These Terms & Conditions (“Terms”) govern access to and use of TheIslandsConnect.com (“TIC”, “Platform”, “we”, “us”). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. About the Platform

TIC provides an online marketplace and related tools for discovering, listing, and inquiring about property in The Bahamas. TIC is a technology platform. We are not a licensed real estate broker, agent, appraiser, attorney, escrow agent, bank, or insurer unless explicitly stated in writing for a specific service.

2. Eligibility

You must be at least 18 years old and capable of entering a binding contract under Bahamian law. By registering, you represent that information you provide is accurate and that you have authority to list or promote any property you submit.

3. Accounts

• You are responsible for safeguarding login credentials and all activity under your account.
• You must notify us promptly of unauthorised access.
• We may suspend or terminate accounts for breach, fraud, abuse, or legal compliance.

4. Listings and user content

When you submit listings, photos, descriptions, prices, or other content (“User Content”):

• You grant TIC a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and promote User Content on the Platform and in marketing reasonably related to the service.
• You warrant that you own or have rights to the content, that listings are truthful to the best of your knowledge, and that publication does not violate law or third-party rights.
• Listings may remain pending review until approved. We may reject, edit requests, downgrade, or remove listings at our discretion.
• You remain solely responsible for compliance with Bahamian property, licensing, tax, and advertising laws applicable to your listing.

5. Plans, fees, and payments

Certain features require paid plans or add-ons. Prices and limits are shown on the Pricing page. Unless otherwise stated, fees are in Bahamian or US dollars as indicated at checkout. Payments may be processed manually or through third parties. Plans may include listing limits; exceeding limits requires upgrade or removal of existing listings.

Except where required by law, fees are non-refundable once a plan period has commenced or a listing has been submitted for review.

6. Inquiries and communications

TIC may facilitate inquiries between users and listing contacts (including WhatsApp or email handoff). We do not guarantee response times, transaction completion, or suitability of any property or counterparty. All negotiations and contracts occur directly between users unless TIC expressly intermediates in writing.

7. Prohibited conduct

You must not:

• post false, misleading, or discriminatory listings;
• scrape, reverse engineer, or overload the Platform without permission;
• upload malware, spam, or unlawful content;
• impersonate others or misrepresent affiliation with TIC;
• Circumvent listing limits, review processes, or security controls.
• use the Platform for money laundering, fraud, or illegal activity.

8. Intellectual property

The Platform, branding, software, and documentation are owned by TIC or licensors. Except for the User Content licence above, no rights are granted. “TheIslandsConnect” and related marks may not be used without written consent.

9. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY BAHAMIAN LAW, TIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ACCURACY OF LISTINGS, AVAILABILITY, TITLE, CONDITION, OR LEGAL STATUS OF ANY PROPERTY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE COMMONWEALTH OF THE BAHAMAS, TIC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY INTERESTS, ARISING FROM OR RELATED TO THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE GREATER OF (A) FEES PAID BY YOU TO TIC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED BAHAMIAN DOLLARS (B$100).

Nothing in these Terms excludes liability that cannot be excluded under Bahamian law (including fraud or death/personal injury caused by negligence where applicable).

11. Indemnity

You agree to indemnify and hold harmless TIC from claims, losses, and expenses (including reasonable legal fees) arising from your User Content, listings, breach of these Terms, or violation of law or third-party rights.

12. Electronic transactions

You consent to receive communications electronically. Where applicable, electronic records and signatures may be recognised under the Electronic Communications and Transactions Act, 2003 of The Bahamas.

13. Privacy

Personal data is processed as described in our Privacy Policy.

14. Suspension and termination

We may modify, suspend, or discontinue the Platform or any feature with reasonable notice where practicable. Upon termination, provisions intended to survive (including licences granted for operational purposes, disclaimers, liability limits, indemnity, and governing law) shall survive.

15. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of The Bahamas. The parties submit to the exclusive jurisdiction of the courts of New Providence, Bahamas, except that TIC may seek injunctive relief in any competent jurisdiction.

Before formal proceedings, parties agree to attempt good-faith resolution by written notice to legal@theislandsconnect.com for thirty (30) days.

16. Changes

We may update these Terms by posting a revised version with a new date. Material changes may require additional notice. Continued use after the effective date constitutes acceptance where permitted by law.
